NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Housing Authority of Owensboro.

REQUEST FOR RELEASE OF FUNDS

On or about September 12, 2022, the City of Owensboro will authorize the Housing Authority of Owensboro to submit a request to the HUD Louisville Field Office for the release of Public Housing Capital Fund Program funds under Section 9(d) and Section 30 of the U.S. Housing Act of 1937, as amended, to undertake a project known as Churchill Park for the purpose of conversion to RAD and the substantial rehabilitation of the residential buildings, demolition of the U-shaped configuration of three (3) structures on the east side of the Domestic Violence Shelter (OASIS) campus and interior renovations for the administrative building.  The subject property consists of five (5) one-story and fifty-three (53) two-story multi-family apartment buildings, one (1) single-story administrative building, one (1) single-story maintenance garage, one (1) two-story building located at 2150 East 19th Street, one (1) single-story building at 2130B East 19th Street, and one (1) building at building at located at 2130G East 19th Street.  The subject property structures contain a total of two hundred forty-eight (248) multifamily residential dwelling units and are situated on approximately 21.64 acres of land. The subject property contains a gross building area of approximately 263,436 square feet. Located within the administrative building are offices, conferences rooms, storage rooms, community kitchens, and a maintenance shop. Located within the OASIS Domestic Violence Shelter are a business center, client bedrooms, a breakfast bar, a dining area, a commercial community kitchen, laundry facilities, offices, and a daycare. Located within the Girls Incorporated building and Boys and Girls Club building are classrooms, a computer lab, a gymnasium, a dining area, storage rooms, a free time area, and community kitchens. Exterior property improvements include playgrounds, a basketball court, picnic areas, landscaped regions, and asphalt parking areas. The subject property is proposed for RAD conversion and substantial rehabilitation. The subject property is serviced by electricity, natural gas, and municipally supplied water and sewer. The site is located in an area of residential and light commercial development bounded by East 18th Street, Leitchfield Road, Baker Avenue, Oak Avenue, East 19th Street, and Churchill Drive.  The sources of funding for the project are as follows:

FINDING OF NO SIGNIFICANT IMPACT

The City of Owensboro has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at Owensboro City Hall, 101 East 4th Street, Owensboro, Kentucky 42303 and may be examined or copied weekdays 8:00 A.M to 5:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City of Owensboro Community Development Department.  All comments received by September 16, 2022 will be considered by the City of Owensboro prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The City of Owensboro certifies to HUD Louisville Field Office that Thomas H. Watson in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD Louisville Field Office’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Housing Authority of Owensboro to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD Louisville Field Office will accept objections to its release of fund and the City of Owensboro’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Owensboro; (b) the City of Owensboro has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD Louisville Field Office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to The HUD Louisville Field Office to CPD_COVID-190EE-LOU@hud.gov. Potential objectors should contact HUD/State to verify the actual last day of the objection period.
